Menendez Brothers’ Attorney Seeks to Disqualify LA County DA in Resentencing Case

MARK GERAGOS, the attorney representing convicted murderers ERIK and LYLE MENENDEZ, has filed a motion to disqualify Los Angeles County District Attorney NATHAN HOCHMAN and his office from handling the brothers’ resentencing case. The motion, filed on Friday, alleges a conflict of interest and is now before Los Angeles County Superior Court Judge MICHAEL JESIC.

The Menendez brothers, currently serving life sentences without parole for the 1989 murders of their parents, are seeking reduced sentences. The next hearing in the case is scheduled for May 9.

The motion, brought under the U.S. and California Constitutions as well as California Penal Code 1424, argues that Hochman’s involvement creates a conflict of interest that could deny the brothers a fair hearing. If the motion is denied, Geragos plans to request an evidentiary hearing and call Hochman and others to testify.

The conflict centers on KATHLEEN CADY, an attorney recently hired by Hochman to lead the Office of Victims’ Services. Cady previously represented MILTON ANDERSEN, the sole Menendez family member opposing resentencing, and filed an amicus brief against the brothers’ case. Geragos claims Cady’s role creates a bias, as she is also a board member of Justice For Murdered Children, a group that publicly condemned the Menendez brothers’ resentencing during a rally headlined by Hochman.

Additionally, the motion alleges that Cady failed to warn Menendez family members about graphic imagery displayed during an April 11 hearing, violating victims’ services laws.

The Menendez brothers were convicted in 1996 after their first trial ended in a mistrial. They have spent 35 years in prison for the murders of their parents, MARY KITTY MENENDEZ and JOSE MENENDEZ, which they claim were motivated by years of sexual abuse by their father.
